 "Settlor Intent vs. Benefit of the Beneficiaries -

Trust Modification Today"




J. Eric Virgil, Esq., a Fellow of the American College of Trust and Estate Counsel, and past chair of the Digital Assets and Information Committee and the Guardianship Practice and Advanced Directives o Committee of the Real Property, Probate, and Trust Law Section of the Florida Bar, will cover the current legal environment related to modification of irrevocable trusts.  In particular, he will discuss the recent statutory changes to Florida Statutes Section 736.103(11), which defines "interests of beneficiaries," and whether those changes affect the continuing viability of trust modification under Florida Statutes Section 736.04115.  


This presentation will also discuss relevant trust modification case law, including the Second DCA's recent Horgan v. Cosden decision regarding settlor intent versus interests of the beneficiaries of a trust.
